Last Will and testament of Nicholas Countz
In the name of God AmenI Nicholas Countz do make and publish this my last will and testament hereby revolking and making void all other wills by me at any time made
First I direct that my funeral expenses and all my debts be paid as soon as possible out of anymay die possessed of or may come into the hands of my executor's
Secondly Igive and bequeth unto my beloved wife Eve Countz a good and comfortable support during her natural life to be secure to her from any claim and right in the land on which we kmow lie. Also two cows and her choice of beds, also my servantwoman named Aggy to stay with her during her life, and shall have and keep herbed. I also will that my beloved wife have and keep for her own use and comfort the greater part of the household funiture that belongs to me.
Thirdly I give and bequeth to my daughter Mary Bean one negro girl named Tener which said negro has been transfered to my daughter Mary to David Noe and is now in his possession
4th I give and bequeth to my son George Countz one negro man named Alexander which said negro man has been transfered by sale by my son George to my son Henry and is now in his possession
5th I give and bequeth to my son William Countz one negro girl named Ferebe which said negro girl has been transfered by my son William to David Noe and is now in his possession
6th I give and bequeth to the lawful heirs of my son Isaac Countz (dec'd) one negro girl named Lucy
7th I give and bequeth to my daughter Margaret Keith one negro girl named Nancy
8th I give and bequeth to my son Nicholas one negro boy named Peter which said negro boy has been transfered by sale by my son Nicholas to myson Henry and is now in his possession
9th I give and bequeth to my daughter Caroline Easly or her lawful heirs one negro girl named Seytha which said negro girl has been transfered by sale from said heirs to my son Henry Countz and is now in his possession
10th I give and bequeth to my daughter Sarah Noe one negro girl named Gemiah
11th I give and bequeth to my son Aaron Countz onenegro boy named John and my son Aaron is to have no futher claims on my estate
12th I give to my son John Countz (dec'd) or his lawful heirs one negro boynamed Alfred
13th I give and bequeth to my son David Countz one negro man named Briant which said negro he had received and is now in his possession many years
14th I give and bequeth to my son Henry Countz after my death and the death of my beloved wife all my right and title and claim in the lands on whichwe now live and which he is now held by heir and me jointly all the hogs and sheep held in partenership
15th I will that all my personal property I may die possessed of be sold by my executors to the highest bidders on a credit of twelve months and the proceeds of said sale shall be united with whatever monies I may die possessed of or may be collected by my executors as belonging to the estate and the money arising from sale of my negro boy named Bryant and said money when it is all collected by my executors shall be by them equally devided among my heirs. Aaron Countz excepted as above
16th I will that my negro boy Bryant stay two years longer with his mother that he be sold by my executors and the money be disposed of as directed
17th I will that my negro woman namedFereby and her children now in the possession of John Smith of Grainger Countyshall at the death of said Smith if possible recovered by my executors and then sold after my executors have been paid for the trouble they may have in recovering them and all lawful expenses are paid the re

COUNTS BILL OF SALE
Know all men by these presents that we George Counts, Nicholas Counts, James N. Counts and William Henderson and his wife Sarah Henderson (alias Counts) of Madison Co. in the state of Arkansas, heirs of estate of Isaac Counts deceased have for this day for and in consideration of the sum of two hundred dollars to us paid to Pleasant Miller Johnson all and singular our claim and interest as heirs at law in in said deceased in and to a certain negro woman slave for life, named Louisannah, aged 19 years, belonging to the heirs of said deceased in common with ourseves hereby warranting our said kinship in and to said Plesant Miller Johnson aforesaid for ever and unto his heirs and assigns for ever.
We do warrant said negro to be sound in body and mind as far asour knowledge extends. We do forever covenant to and with the said Johnson that we will for ever warrent and defend the right and till to our said heirship to send negro woman to said Johnson and do bind ourselves and assigns to do the same for us. In testimony wherof we have hereunto set our hands and seals this day of January A.D. 1845. Executed and delivered in our presants attist.
