Sep. 1841 On the motion of Ellis Counts, The widow having filed her relinquistment, ordered that said Ellis Counts be appointed Administrator of Nicholas Counts, deceased. on his entering into bond with good sufficient srcurity as the law directs.
7 Dec. 1841 Ellis Counts, administrator of Nicholas Counts, deceased, presents an appointment bill of the personal estate of said deceased, amounting to $204.60. Also a bill amounting to $63.00. Also a list of articles retained by the widow at their appraised value ammounting to $119.80 wherein are examined, approved and filed.
3 Sep. 1844 Ellis Counts, administrator of Nicholas Counts, deceased, presents his account current from which it appears thatassetts to the account current from which it appears that assetts to the amount of $63.00 have come to the hands of said administrator and that said administrator has paid out fees and expenses and for debts due and owing by said estatein the first and second classes the sum of $79.38, leaving the estate indebtedto said administrator in the sum of $16.38, which account is examined, approved and filed. I, Nicholas Counts of the county of Madison in the State of Missouri, being of ------ domake and publish this last will and testament as follows.
I. I direct and request that my funeral expenses and all of my debts be first paid out of my estate
2. Then I give and bequeath unto my beloved wife Louisa Counts. If she shallsurvive me all of my estate real and personal and mixed and wheresoever to have and enjoy to her own seperate use and enjoyment for and during her natural life, and at her death or at my death if I shall survive my said wife.
3. I giveand bequeath unto my son Nicholas J. Counts, in addition to what I have already given him as his full share and interest in my estate the south half of the southwest guarter of the northwest quarter of section 80, in the township 84 N. Range S. East, containing 20 acres of land in Madison Co, Mo. to have and hold the, (smudged can't read) --- --- --- to himself, his heirs and---.
4. I give and bequeath unto my daughter in law Mary Ann Counts, widow of my dead son W. Counts, and to the heirs of Adomiram Counts any deceased son (except Charles Counts, his ----) and to my daughter Louisa J. Stephenson, and to my son John P. Counts, each ten acres of land in the East half of Northwest quarter of section 80, in township 34 N. Range 8 East in addition to what I have already given them as their full share and in any estate to have and to hold the same, then their heirs and assigns forever.
5. I give and bequeath unto my daughter Sarah Stewart, wife of W. J. Stewart the sum of five dollars in addition to what I have already given her as her full share and interest in my estate.
6. I give and bequeath unto my daughter Mary A. Schults all of the -- --- -- - - -- - --- my death or the death of my wife Louisa Counts which ever event shall last occur both real, personal and -- wheresoever situate --------17 94/100 acres of land inEast half of North West quarter of section 30 township 34 N. Range 8 East and not bequeathed or disposed of above together with any and all other lands of which I may die signed and posessed of or --to have and to hold the same to the son of Mary A. Shults her heirs and assigns forever.
7. I hereby appoint William H. Higdon, executor of this my last will and testament. In witness this fifthday of May, 1885.

first child to Lick Creek near the mouth of Dog Branch, downstream

1854. His pioneer life was similar to that of his brother-in-law,
William Sutherland, except that he was further from the mills and
stores of the Clinch settlements.

Most birth records are from census, so ages of children are questionable. Liddie Counts, a gr.dau.of Andrew Jackson, son of Richard, remembers hearing her gr.parents argue about the children Julia had, after Richard was gone. She and other family members say John B. Counts, brother to Richard, was thefather to some of Julia's Children.
