Last Will and Testament of William Parks Counts
I, William Counts, of the county of Ste. Genevieve, and the state of Mo. do make and publish this my last will and testament. I devise my beloved wife Elizabeth the house in which I now live and buldings appurtant to the same and the household furniture of every kind now being in said house and the following tract of land, to wit. The NW 1/4 of the SW 1/4 of sec. 15, twp. 36, R 7 E. To have and hold the said Elizabeth for turn of her natural life in liew and in full satisfaction of her dower and of all her rights of dower in and out of all the lands and tenements of which I may be seized during my marriage with said Elizabeth.

Secondly, I will that their shall be sold of my personal property a sufficient amout to pay all my just debts after which the ballance shall be placed in the hands of my wife Elizabeth for use and benefit of my minor children.

Thirdly, that all money that may cum to hand shall be put on interest, and the interest of which is to be anually applied to the use of my minor children, and the principal remainuntill the youngest child becomes of age then to be disposed of in the same manner as I have provided as I hereafter provide for the balance of my real estate.

Fourthly, I will that all my real estate not above disposed of shall remain undivided untill my youngest child becums of age. I further will that my sonNicholas M. Counts nd my daughter Elizabeth, the wife of William Mitchell, shall receive an equal benefit in the use and benefit of the island tract untill the time set for dividing said estate and the profit, use and income of all the rest of my real estate shall belong to the rest of my children untill the time set for dividing the same.

Fifthly, I will that it be understood that previous to this time I devise to my son Nicholas M. Counts a certain tract of land described as follows. The W 1/2 of the SE 1/4 and SE 1/4 of twp. 3N of R. 7E, containing 120 acres, which land I value at $250.00, which amount shall out of son's interest when the above name division is made.

Lastly, I will to bodily heirs a equal share of my real estate their natural life time and then to fall to their bodily heirs and in the event either one of my children should die without heirs shall fall back to the living brothers and sisters. In witness whereof, I have hereunto set my hand this 30th day of Oct, 1860.

Joseph COUNTS64 was born in 1789 in Russell Co., VA. He died in Mississippi. He was buried in Iuka, Mississippi. His education was above average for his day. He taught several
schools on
Clinch River and at Sandlick. On 6-3-1817, he was appointed a
constable of
Russell Co. and executed a $500 bond with John Howard as surety.
About this
time he moved to Tilda Anderson Bottom near Sandlick, the home of his
brother
in law, Richard Colley [C14 husband]. They lived there about 8 years.
Their

nearest neighbor, except Dick Colley, was Henry Sutherland - 20 miles
away
across Sandy Ridge on Dumps Creek. In October 1835, Joseph became a
member of
the Reeds Valley Baptist Church. The following May he moved his
membership to
Castlewood Baptist Church where his wife had been a member since
December
1835. He represented his church as a messenger to the Washington
Dist.
Baptist Association in 1837. On 6-15-1827, he bought from Truelove
Brown and
others an interest in a 100 acre tract of land at Carterton on Clinch
River
and moved to this homeplace. Then on 8-21-1832, he bought from Polly
Brown
and others their interestin the same tract known as "The Brown Farm".
He was
Overseer of the Poor in 1852. About 1859, a brother-in-law, James
Long, who
was a large slave owner in Alabama, willed five of his slaves to
Joseph and
Sallie Long Counts. Joseph made a trip down there to secure these and
other
slaves bequeathed to Russell Co. relatives by James Long. He liked
the
country so well that he soon moved to Tishomingo Co., Miss, where his
brother
in law, Henry Long, had been living for several years. Joseph
conveyed a
tract of land in Russell Co. to John H. Jessee on 4-2-1860 (Tish Co.
Miss D B
14, p 449). His last years were spent at the home of his son, Andrew
J.
Counts, near Iuka, Miss, where he and Sallie are buried.

Joshua COUNTS64 was born on 27 August 1801 in Russell Co., VA. He died on 15 February 1883 in Russell Co., VA. He was buried in Joshua Counts Grvyrd, Cleveland, RC, VA. They lived south of the Clinch River on land willed to himi by his
father (the
present site of Cleveland). Martha was a member of the Reeds Valley
Baptist
Church and is buried in the Ezekiel Counts Cemetery at Cleveland. Her
premonition of approaching death and expressions of devout faith
during her
last illness were recorded in a small booklet probably published by
her son
Elijah. Her descendants treasure those memoirs today.
During the Civil War he served several months in the Confederate
Quartermaster
Dept. at Bristol. He served as a deacon for many years [for the Reeds
Valley
Baptist Church] and represented his church as a messenger to the
Washington
District Associaton. Joshua was bedridden with rheumatism the last
six year
of his life.

Richard Colley first appears as a head of household in the 1820
Census of Virginia, he is a resident of the Lebanon District of
Russell County. Richard was known as "Fighting Dick Colley" and was
the first permanent settler of the Dickenson County territory. He
served in the War of 1812. He was a noted hunter and farmer and lived
most of his life near Sandlick. Sources describe him as "a medium
sized man with square shoulders; fast tempered, hard drinking and hard
fighting." Living in his household in the 1850 Russell County,
Virginia Census was: Elizabeth Ramey (age 14), Harvey Ramey (age 7),
Catherine Colley(age 8), Jefferson Pressley (age 4), and Joshua
Pressley (age 2). Richard is listed as age 54 and a farmer, the value
of real estate owned was listed as $400.00 in 1850.

"SOME DESCENDANTS OF JOHN COUNTS OF GLADE HOLLOW" By: Sutherland
(p185) states that the children listed in the above Census are
"Grandchildren reared by Richard and Christina" and also that "Harvey
later took the Colley name." The 1850 Census also states that
Elizabeth Ramey was born in Kentucky; the other children were born in
Russell County, Virginia. Census also notes Catherine Colley is
"Deaf."

Richard served with Capt George Kindrick's Infantry Co., 72nd. Reg..

Prior to marriage, Dick Colley was the caretaker of a large boundary of mountain land belonging to Andrew Hebern at Sandlick, to which they moved and made their home. Here in the midst of the Sandy Basin wilderness they became the first permanent settlers in what is now Dickenson Co. Dick literally blazed a trail from the Clinch Settlements across Sandy Ridge and through a virgin wilderness fifty miles to the very border of Kentucky, and made his indelible mark as a community builder during its catalysmic change from a wilderness to a farming community. He was the moving force that secured the first public road to Sandlick. He owned and operated the first water mill in that section. In 1852, he was appointed one of the commissioners to divide Russell County into eight voting districts, and his home was established as one of the two voting places in the 4th (Sandlick) district. He did not perfect title to any land, but his sons owned many thousand acres in this section which he settled and helped to improve. In 1936, Hawk Fuller [E548], remembered his grandfather, "Fightin' Dick", as "medium sized, not large, but big square shoulders, bald-headed and smooth shaven." In a biography (Some Sandy Basin Characters - 1962) EJS stated: "Dick Colley was strong of limb, heart and temper. It took all that to conquer the wilderness. No one ever questioned his bravery, nor did anyone who ever felt the wallop of his bruising fist soon forget its crushing power. His hot temper, often unleashed and terrible, swung him from one personal encounter into another with his neighbors ... He was often wobbly with hard liquor, his heart and strength carried him through ... It seemed that he had more fights with John Fuller than any other man ... One day they met in the woods, and as usual got into a quarrel. John managed to get the first blow which knocked Dick almost unconscious. While Dick lay on the ground, John danced around him singing ...

'Poor old Dick he died of late;
Straightway he went to Heaven's gate.
There he met the Devil with a club,
And drove him back to Beezlebub!'

By the time John had finished his song Dick felt he could handle him,
and got
up and won the fight."

He became a famous hunter and many thrilling tales about his hunting prowess are still recalled - the most famous being the time he killed a bear with his bare hands. He was a member of Capt. George Kendrick's Company of Infantry, 72nd Reg, in Russell Co., and was called into active service on Feb 4 1815, but the war of 1812 soon ended and he saw no further active service. He died while visiting his son Joshua on Grassy Creek and is buried there in the Mullins Graveyard.
